Agreement to Terms
By accessing lymmco.com or joining the SpoonWrap waitlist, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, please do not use our site or submit your information.
These Terms are between you and LymmCo, 40315 Michigan Ave #566, Canton, MI 48188, United States ("LymmCo," "we," "us").
The Waitlist Service
LymmCo currently operates a pre-launch waitlist for SpoonWrap, a product under development. The waitlist allows interested individuals to register their email address to be notified when SpoonWrap becomes available for purchase.
Joining the waitlist does not:
- Constitute a purchase, reservation, or pre-order
- Guarantee access to SpoonWrap at any particular time or price
- Create any contractual obligation on LymmCo to sell you a product
- Guarantee that SpoonWrap will launch at all
Waitlist position is first-come, first-served and is non-transferable. We reserve the right to modify waitlist order, limit availability, or cancel the waitlist at any time without notice.
Eligibility
You must be at least 16 years of age to join the waitlist or use our website. By submitting your information, you represent that you meet this requirement. If you are under 18, you represent that you have obtained parental or guardian consent.
Acceptable Use
You agree not to:
- Submit false, misleading, or fraudulent information
- Register multiple times using different email addresses to gain unfair waitlist priority
- Use automated tools, bots, or scripts to interact with our site
- Attempt to gain unauthorized access to any part of our systems
- Use our site for any unlawful purpose or in violation of any applicable law
- Reproduce, scrape, or redistribute any content from our site without permission
Intellectual Property
All content on lymmco.com — including but not limited to the LymmCo name and logo, the SpoonWrap name, product designs, graphics, photographs, copy, and code — is owned by or licensed to LymmCo and is protected by United States and international intellectual property laws.
You may not copy, reproduce, modify, publish, transmit, distribute, or create derivative works from any LymmCo content without our prior written consent.
Communications
By joining the waitlist, you consent to receive email communications from LymmCo related to SpoonWrap, including launch notifications, updates, and related announcements. You may unsubscribe at any time by clicking the unsubscribe link in any email or by contacting us at hello@lymmco.com.
Disclaimers
OUR WEBSITE AND WAITLIST SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. LYMMCO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We make no warranty that the site will be uninterrupted, error-free, or free of viruses. Product descriptions, renderings, and specifications are subject to change before launch.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, LYMMCO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE OUR SITE OR WAITLIST SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for any claims arising from these Terms or your use of the site shall not exceed $100 USD.
Third-Party Services
Our website is hosted by Shopify and uses Google services for data storage. Your use of these third-party services is subject to their respective terms and privacy policies. LymmCo is not responsible for the practices of any third-party service providers.
Privacy
Your use of our site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of the site after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
Governing Law & Disputes
These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Wayne County, Michigan, and you consent to personal jurisdiction in those courts.
If you are located in the European Economic Area, you may also have the right to bring claims before your local courts or regulatory authorities under applicable consumer protection laws.
Severability
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
